DC Water requires covenants for special water and sewer facilities constructed by private citizens and companies within public space or easements owned by DC Water or the District of Columbia. The applicant must agree to perpetually operate and maintain the water and/or sewer facility that they constructed in public space. This covenant must be recorded with the land records so that it will convey when the property is sold to another person or company. The DCRA office will manage and approve this type of covenant. A covenant is also required if the applicant plans to construct a building or facility over either a water main or a sewer within an easement on their property. DC Water will review and sign this covenant with the applicant.
